Abstract

Without metadata, the value of the stock shots archived as audiovisual heritage decreases due to the limitations of content retrieval. A number of archives are not catalogued yet, and others have a metadata structure but need to be re-catalogued and re-indexed. Incomplete metadata, legal issues related to the right to be forgotten, new relevance of events or people, or new journalistic approaches to the information are some of the triggers of this requirement, which is extremely complex and sometimes unviable. This leads us to assume that there are certain unachievable limitations on audiovisual archives management.

Abstract

Law and Information are two concepts that need each other, although the complexity of their relationship is not always fully understood. We propose an overview of the main areas where this relationship is more intimate and fundamental. To make this overview more comprehensive we will focus on the three functions that Law can exercise over Information: hide, preserve and share. All topics discussed are highly related and the discussion of one has to take into account the other. The good news is that Law has been responding to the needs of the society due to the challenges posed by technological and social changes for millenia and it has the tools to do it again. For this, legal practitioners need the support of information professionals to guide them through all the new phenomena arising from digital information.

El desarrollo del periodismo en la Web ha facilitado el acceso a los archivos de los diarios, generando en ocasiones, a los protagonistas de las noticias la dificultad de superar pasajes de su vida que quedaron reflejados en la prensa. La gestión del derecho al olvido excede al ámbito jurídico y adquiere un componente ético. En este trabajo indagamos en las actuaciones que desde esa perspectiva están llevando a cabo las instituciones periodísticas, prestando atención a aquellos medios europeos de referencia que han fijado públicamente su postura sobre esta materia. Las iniciativas son muy escasas y el debate incipiente parece haber quedado relegado a un problema interno de cada medio. Abstract The development of online journalism has facilitated easy access to newspapers’ archives by the general public. The management of the right to be forgotten goes beyond the judicial realm, and takes on an ethical component.
