International Binding Charter on Artificial Intelligence Liability, Auditability, and Temporary Legal Personality

Abstract

Note: This is a modified charter created using artificial intelligence. It was given ideas, which it then organized and defined into clauses that could serve as a charter.

This international Charter is the outcome of a collaborative research effort undertaken with a member of my family, driven by a firm conviction that justice in the age of artificial intelligence cannot be achieved without reconstructing the foundations of accountability itself. This work confronts the most critical legal gap of our era the accountability gap where harm occurs yet no identifiable human actor can be held responsible.

The Charter introduces Temporary Legal Personality (TLP) for artificial intelligence as a practical and realistic corrective mechanism activated solely during investigation and liability assessment, ensuring that victims are compensated without hindering technological innovation. It proposes a binding international framework encompassing liability, auditability, cross-border jurisdiction, and automatic compensation constituting the first fully engineered legal architecture designed specifically for autonomous systems.

A detailed and realistic case study demonstrates beyond doubt the Charter’s feasibility at the international level, particularly in scenarios involving cross-border harm caused by self-governing AI systems. This example shows that activating Temporary Legal Personality does not grant AI human-like status or permanent legal standing; rather, it provides a decisive legal tool to prevent cases of autonomous harm from collapsing into a vacuum of responsibility.

A subsequent companion file will be released to clarify the technical and legal terminology that may appear ambiguous, offering interpretive guidance to ensure coherent understanding of the Charter’s core principles among scholars, practitioners, and policymakers.

This work marks the beginning of an entirely new legal phase one in which justice becomes enforceable against autonomous systems, transcends national boundaries, and overcomes the silence of traditional law.
